Lystmark Platforms Terms of Use

This Terms of Use (the "Agreement") govern your access to and use of the services, products, and software provided by and Lystmark Platforms LLC d/b/a Lystmark Platforms, together with its affiliate entity Lystmark Company LLC, both Ohio Limited Liability Companies, collectively d/b/a The Lystmark Company, (”Lystmark,” "Company," "we," "us," or "our"), concerning your access to and use of the Company’s software platforms, services, and products.

Scope of this Agreement This Terms of Service Agreement ("Agreement") applies to your access to and use of Lystmark Platforms services, including any software, applications, or features available through Lystmark.com and any other related sites or applications operated by Lystmark Platforms. By using Lystmark Platforms services, you agree to be bound by the terms outlined in this Agreement, as well as any additional terms that may apply specifically to services provided by Lystmark Platforms.

Your use of Lystmark Platforms is also governed by our Terms of Use, which outline specific guidelines, permitted uses, and user responsibilities when accessing and interacting with our software and services. By using Lystmark Platforms, you agree to comply with both this Terms of Service and the Terms of Use.

1. Acceptable Use Policy

You agree to use our services only for lawful purposes and in accordance with these Terms of Use. Any misuse of our services, including but not limited to the following prohibited actions, may result in immediate suspension or termination of your account:

• Unauthorized Access: Attempting to gain unauthorized access to our systems, servers, databases, or other users' accounts.
• Data Scraping and Mining: Engaging in data scraping, data mining, or other automated activities to extract data without prior authorization.
• Reverse Engineering: Attempting to reverse engineer, decompile, disassemble, or otherwise interfere with our software or platform architecture.
• Harmful Activity: Uploading or distributing malicious code, viruses, or any other harmful technology that could damage or disrupt our services.
• Unlawful Content: Posting, uploading, or sharing any content that is illegal, fraudulent, defamatory, harassing, or infringing on the rights of others.
• Interference: Intentionally interfering with or disrupting the functionality of our platform, including any attempts to overload, flood, or crash our servers.
• Commercial Exploitation: Using the platform for unauthorized commercial purposes, including reselling access or services without express permission from Lystmark.

2. User Responsibilities

As a user of Lystmark Platforms, you are responsible for:

• Maintaining Account Security: Keeping your login credentials secure and confidential. You are solely responsible for all activities that occur under your account.
• Providing Accurate Information: Ensuring that any information you provide to us, including registration and billing information, is accurate and up to date.
• Compliance with Applicable Laws: Adhering to all applicable local, state, national, and international laws while using our platform.
