These Terms of Service (the "Agreement") constitute a legally binding agreement made between you ("User," "you," or "your") and Lystmark Company LLC or it's subsidiaries and affiliates, collectively d/b/a The Lystmark Company or Lystmark (”Lystmark,” "Company," "we," "us," or "our"), and applies to your access to and the use of our, services, products, platforms and websites provided by Lystmark Company LLC and its affiliates. By accessing or using any of our services, you agree to comply with and be bound by the terms outlined in this Agreement. If you do not agree with these terms, you must refrain from using our services.

This Terms of Service Agreement ("Agreement") applies to your access to and use of Lystmark.com and any other websites, platforms, applications, or services operated by Lystmark and its subsidiaries. By using Lystmark.com or any related sites or subdomains, you agree to be bound by the terms outlined in this Agreement, as well as any additional terms that may apply to specific services provided by Lystmark or its affiliates or subsidiaries.

Additional Terms for Certain Services

Lystmark may offer certain services, features, or products that require you to agree to additional terms before use or access. These additional terms will be presented at the time of use and will apply alongside this Terms of Service Agreement. In the event of a conflict between these Terms and any specific service agreement, the additional terms will govern to the extent of the conflict. Certain services offered through Lystmark Platforms LLC d/b/a Lystmark Platforms may be subject to additional terms, including but not limited to the Lystmark Platforms Terms of Use and Lystmark Platforms Terms of Service. These additional terms are incorporated herein by reference and must be accepted before accessing or using the applicable services.

By accessing or using any of our services provided by The Lystmark Company or any other subsidiaries or affiliates, you confirm that you have read, understood, and agreed to this Agreement. Specific services may require acceptance of additional terms, which will be presented to you at the point of use.

This Agreement applies to all services provided by Lystmark and its subsidiaries. Certain services or features may require acceptance of additional terms presented at the time of access. For example, users of Lystmark Platforms LLC (d/b/a Lystmark Platforms) are also subject to the Lystmark Platforms Terms of Use and Lystmark Platforms Terms of Service, which govern those specific offerings. In the event of any conflict between this Agreement and the terms of a subsidiary or specific service, the more specific terms will control.

4. Intellectual Property

All intellectual property rights in and to our services, including software, content, graphics, text, logos, and proprietary technology, are owned by Lystmark or its subsidiaries. You are prohibited from copying, reproducing, distributing, or creating derivative works from any proprietary materials without express written consent.

• Limited License: Subject to compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable license to use our services for personal or authorized business purposes only. This license does not grant you any rights to modify, sublicense, or resell any proprietary materials.
• Third-Party Content: Certain content on our platform may include materials from third-party providers. Your use of such third-party content is subject to any terms provided by the third-party source, and Lystmark Company disclaims any liability for such content.
